Section 1

Nature of Service

WaiverReview.com provides independent educational analysis, administrative consulting, and continuous quality improvement (CQI) advisory services for behavioral documentation and service optimization. Our written technical feedback, programmatic recommendations, and reviews constitute professional, peer-level educational guidance for internal agency training purposes.

Section 2

Not an Audit or Clinical Service

Services provided under this website do not constitute official state or federal compliance audits, legal counsel, or direct clinical interventions. The owner acts purely as an administrative documentation and programmatic optimization consultant, not as a direct clinical care provider for your clients.

Section 3

Complete Limitation of Liability (Clawback Waiver)

The contracting agency retains 100% legal ownership, authority, and ultimate responsibility for all behavioral documentation, assessments, progress notes, and service delivery models submitted to state or federal entities. WaiverReview.com, its owners, and affiliates shall not be held liable or financially responsible for retroactive funding clawbacks, programmatic sanctions, administrative penalties, or adverse regulatory outcomes executed against the agency by the Maryland Department of Health (MDH), the DDA, or any other oversight body.

Section 4

Secure Protocol Mandate

To support standard HIPAA data security protocols, clients are strictly required to utilize the unique, restricted-access Secure Document Vault link directly emailed to them upon onboarding. WaiverReview is indemnified and released from liability regarding any data breaches or HIPAA violations if an agency client chooses to bypass secure protocols by transmitting unencrypted PHI via standard email, text messages, or unapproved third-party channels.

Section 5

Governing Law & Severability

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any legal action arising under these terms must be brought exclusively in the state or federal courts located in Maryland. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
